Welcome, and thank you for being here.
These Terms & Conditions are designed to create clarity, mutual respect, and safety for everyone involved.
By booking or participating in any class, workshop, session, event, retreat, corporate offering, or other service (collectively the “Services”), you agree to the following Terms & Conditions.
1. Nature of the Space
Niyana Yoga operates as a small, pre-registered community practice space located within a private residence. Advance booking is required and drop-ins are not permitted. Capacity is limited to maintain a safe and calm environment. All Services are provided for educational and wellness purposes only and are not medical, psychological or therapeutic treatment.
2. Booking, Payment and Passes
2.1 A booking is confirmed once it has been accepted and any required payment has been received.
2.2 Pricing, pass options and any applicable taxes are provided at the time of booking.
2.3 Class passes are valid for three (3) months from the date of purchase unless otherwise stated and are non-refundable.
3. Cancellation Policies
3.1 Group Classes: Cancellations must be made at least twelve (12) hours before the scheduled start time to receive a credit. Late cancellations and no-shows are non-refundable and non-creditable.
3.2 Private Sessions: Rescheduling is permitted up to twenty-four (24) hours in advance. Cancellations within twenty-four hours are charged in full.
3.3 Events and Workshops: Cancellation terms are stated at the time of booking. Unless otherwise specified, event purchases are non-refundable.
3.4 Corporate Sessions: Cancellations or rescheduling requests made more than seventy-two (72) hours before the session are free of charge. Requests within seventy-two hours are subject to a 100% cancellation fee. Ongoing corporate programs are governed by separate written service agreements.
3.5 Niyana Yoga reserves the right, in its sole discretion, to make exceptions in documented cases of injury, pregnancy or serious illness.
4. Right to Refuse or Remove Participation
To maintain a safe and respectful environment, Niyana Yoga reserves the right to refuse or discontinue participation, without refund where appropriate, where conduct is disruptive, unsafe or not aligned with the nature of the space.
5. Personal Belongings
Participants are asked to bring only essential items. Niyana Yoga is not responsible for lost, stolen or damaged personal property.
6. Media
Niyana Yoga and its authorized representatives reserve the right to capture photographs, video recordings, or other media (“artefacts”) during classes, events, retreats, or related operations.
Such artefacts may be used for promotional, educational, or commercial purposes without compensation to participants.
Participants will be informed in advance when recording occurs and may withdraw consent prior to or during the event. Reasonable efforts will be made to exclude those who decline participation.
Participants are strictly prohibited from recording classes or events without prior written permission.
7. Privacy
7.1 Niyana Yoga collects only the personal information necessary to manage bookings and to support a safe practice environment. This may include a participant’s name, contact details, emergency contact (if provided) and relevant health or accessibility information voluntarily disclosed by the participant.
7.2 This information is used solely for scheduling, communication, safety during sessions, and the administration of passes and payments.
7.3 Payment information is processed through third-party providers and is not stored by Niyana Yoga.
7.4 Personal information is kept confidential and is never sold or shared, except where required for safety or by law. Participants may request access to or deletion of their personal information at any time.
7.5 By providing a telephone number, participants consent to receiving messages related to bookings and class communication. Message frequency is limited to scheduling and studio updates.
8. Waiver and Assumption of Risk
8.1 Participation in all Services is voluntary. Participants are responsible for their own physical, mental and emotional well-being.
8.2 By attending, participants confirm that they are physically able to take part in gentle to moderate movement, breathwork, sound practices and extended postures.
8.3 Participants agree to inform the instructor of any injuries, medical conditions, pregnancy, recent surgery or other limitations prior to participation and understand that they may be advised to attend a private session instead of a group class.
8.4 Any health information provided is voluntary and used solely to support a safe practice environment.
8.5 Participants understand that yoga, breathwork, sound practices and related activities involve inherent risks, including but not limited to muscle strain, injury, dizziness, changes in breathing, emotional release and the aggravation of pre-existing conditions.
8.6 Participants agree to move within their own limits, rest when needed and stop any activity that causes pain or discomfort.
8.7 Hands-on assists may be offered, and participants may decline touch at any time for any reason.
8.8 By participating, participants knowingly and voluntarily assume all risks associated with the Services.
8.9 To the fullest extent permitted by the laws of Ontario, participants release and hold harmless Jillian, operating as Niyana Yoga, the property owner, and any assistants from any claims, injuries, losses or damages arising from participation, except in cases of gross negligence where such limitation is not permitted by law.
8.10 Any liability, if established, shall be limited to the amount paid for the specific Service.
9. House Guidelines – Residential Practice Space
9.1 The studio is located on the third floor and is accessed by two flights of stairs. By attending, participants confirm they are able to use stairs safely and independently and agree to use the handrail and move mindfully.
9.2 Participants may arrive no earlier than fifteen (15) minutes before their session. The studio door closes promptly at the scheduled class start time. Late may not be possible once a session has begun.
9.3 Shoes are removed at the entrance. Bare feet or indoor socks only are permitted.
9.4 Participants agree to arrive and depart quietly and to avoid gathering outside the entrance in order to respect neighbours.
9.5 Street parking only is permitted. Driveways and local signage must be respected.
9.6 Classes are limited to a small number of participants to preserve safety and space.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the laws of Canada applicable therein.
